STAGE 1 – INVITATION OF PARTIES TO PARTICIPATE IN MEDIATION
Once a request is received for mediation to commence, a written invitation is issued to all parties with a view to organising the necessary intake sessions. Once the parties agree to mediate, the parties are provided with a mediation agreement (Agreement to Participate in Family Dispute Resolution) to sign and return to Marc.
STAGE 2 - FIRST PARTY INTAKE SESSION
This confidential process can be conveniently conducted via teleconference. The party provides background to the matter, allows the party to identify concerns, difficulties and issues for resolution between the parties.
STAGE 3 - SECOND PARTY INTAKE SESSION
Per Stage 2.
STAGE 4 – MEDIATION SESSION
The mediation is conducted with Marc at a convenient location to the parties and may progress in an appropriate mode (face-to-face, shuttle where parties are in different rooms, teleconference or Skype, or mixed modes as required). Mediation can be attended by the parties in person or via the assistance of legal representatives. The parties can identify and discuss issues, enable views and opinions to be expressed in a courteous manner, and generate options with a view to arriving at a resolution that the parties can live with.
STAGE 5 – FINALISATION OF AGREEMENTS/CONSENT ORDERS
(where reached by the parties)
At the mediation, where that parties are able to reach settlement on matters, Marc can reduce the terms to an agreement that the parties may execute. The agreement may then also be reduced to a form that can be filed in the Family Court (draft consent orders). A copy is provided to each party.
